Wills. Probate. Trusts
We all like to think we are in control of our affairs and every day finances. Making a Will gives you peace of mind because it makes your final wishes clear. It is also an important gesture to your family and friends, relieving them of possible worry about what to do for the best, when you are no longer there.
For business owners or high net worth individuals you may have more complex issues to consider when making your Will such as tax planning, who will run your business in the event of your death or who you should pass your company shares onto?
Our experienced advisors have helped thousands of people make tax efficient Wills.
There are many reasons for making a Will including if:
- You have just got married
- You have children who need to be looked after once you die
- You are not married to your partner
- You are recently divorced or will be getting divorced soon
- You own your own property
- You own or part own your own business
- You have come into money
- You think you may have to pay Inheritance Tax
By making a Will you can decide:
- Who you would like as your executors to sort out your affairs
- Who will care for your children if they are aged under 18
- Who will receive heirlooms or other specific items
- Who will receive the rest of your money and upon what conditions
- If you would prefer to be cremated or buried, and whether you wish to donate your organs for transplant
Probate
If you have been granted Probate, it means you have been given legal responsibility for dealing with the financial affairs of someone who has died. This includes: bank accounts, property and any other assets there might be.
If a Will has been made, the named Executors will be granted Probate. If not, then the next of kin (as defined by Act of Parliament) can apply for Letters of Administration, giving them the power to act on behalf of the deceased.
Andersons Solicitors understand the amount of strain that this can put on you, so with our experience we are able to relieve you of this burden and ensure that it is dealt with promptly and efficiently.
If you are an Executor or the Administrator we will help you:
- Gather in assets, close bank accounts, claim insurance money
- Sell any property or shares
- Run the deceased’s business or appoint someone to run/sell the business/es
- Pay off any debts and settle any tax affairs with the Inland Revenue
- Distribute bequests specified in the Will
- Distribute assets according to the law if there isn’t a Will
Trusts
A Trust can be a useful way of ensuring that your wishes are carried out in relation to particular assets in a variety of situations. We can advise you on the different types of Trusts and which is most appropriate for you. We will set up the Trust for you and we can also advise and help with Trust Administration.
