This month sees an important opinion
handed down by the Advocate-General which if followed by
the European Court of Justice itself has wide-reaching
implications for UK discrimination legislation.
Another Advocate-General’s opinion addresses holiday pay
while from the UK courts and tribunals come decisions on
territorial jurisdiction, redundancy consultation,
protective awards, time limits for lodging claims, and
recurring disability.

The New Year heralds the annual increases
in tribunal awards – they take effect next month – and
sees some interesting decisions from the courts on TUPE
transfers and ill-health retirement.
The Employment Bill 2007-2008 — which includes
abolishing the statutory disciplinary and grievance
procedures — was published last month, while other
legislation in the pipeline extends the scope of the Sex
Discrimination Act 1975 and tightens up the framework
regulating employment agencies.

A quick reminder: the minimum annual leave entitlement
for all employees increased to 4.8 weeks (equivalent to
24 days for those working 5 days per week) from 1st
October. In addition, the national minimum wage
increased for adults to £5.52 per hour.
And from the courts, there's a ruling on the
introduction of new evidence on appeal, one on equal
pay, and another on conduct and capability
investigations.

New legislation on corporate manslaughter takes effect
next Spring and the Government has included in its new
legislative programme a Bill which will revisit some
existing employment law measures and streamline others.
The UK meanwhile stays firmly at the foot of the EU
holiday ladder, despite the extra entitlement coming
into force next month.
