Funding Advice - Employee

We appreciate that the first question anyone seeking legal advice will want to know is how much will it cost.

1.      Legal expense insurance and Family Legal Protection policies

Many workers have the benefit of Legal Costs Insurance or Family Legal Protection policies, which typically provide up to £25,000 cover for legal fees.

Researchers have estimated that:

·         around 2 in every 5 adults have the benefit of LEI; that's around 16.9 million people in the UK

·         at least 65% motor insurance policies include this cover

·         at least 50% of house contents or buildings insurance policies include this cover

However, research suggests that a significant proportion of people are unaware that they have this class of insurance, presumably because it is often included free or as an add on to their:

a)     House contents insurance

b)     House buildings insurance

c)     Car insurance

d)     AA cover

e)     RAC cover

f)       Travel insurance

g)     Bank accounts

h)     Credit cards

i)        Pet Insurance

j)       Other insurance type policies

Often you may be covered even if the policy is not in your name provided you live in the same household as the policy holder.

According to the Equal Opportunities Commission, many insurance companies try very hard to dissuade clients from using a solicitor of their choice as they prefer to instruct in-house lawyers or solicitors from their panel.

However there are legal provisions, which state that the insured person has a right to choose their own solicitor.

2)  No win no fee

We are able to offer no win no fee funding for Employment Tribunal claims and Compromise Agreements.

a)     no win no fee Employment Tribunals: if you do not have Legal Costs Insurance, and we believe that you have a reasonable prospect of succeeding in a claim worth £2000 or more, we will consider taking on your case on a no win no fee basis.

If we agree to act on a 'no win, no fee' basis and we lose the case we charge you nothing.

If we do succeed in securing compensation our fees will be limited to a fixed percentage of your settlement.

It is often difficult to accurately assess whether or not you are likely to win your case at the outset. However as the case progresses further information will come to light which will help us in assessing your prospects of success and likely awards of compensation. We will keep you updated with our view of the likely outcome of your case and any particular strengths or weaknesses. Because we share the risk of the case being successful, we will only continue acting for you if we think your case has a reasonable prospect of success.

b)   no win no fee compromise agreements
 

Some employees who have been offered a package under a compromise agreement do not want to risk incurring legal costs by seeking to negotiate more   favourable terms.
 

In appropriate cases we can manage that risk by undertaking negotiations on a no win no fee basis.

If we agree to act on a 'no win, no fee' basis and we fail to secure additional compensation we charge you nothing over and above any contribution to your costs that your employer agrees to make. If we do succeed in securing additional compensation our fees will be limited to a fixed percentage of the increase in the value of your settlement in addition to any contribution to your costs that your employer agrees to make.  Please note that this arrangement does not cover the cost of enforcing your rights in an Employment Tribunal or before the Courts in the event that agreement cannot be reached on the terms of a compromise agreement.

3) Hourly rates or pay as you go

Our hourly rates vary depending on the seniority of the lawyer acting for you. We are happy to discuss our hourly rates with you and provide you with an estimate of the total costs.

4)  Fixed Fees

Where appropriate we are happy to consider fixed fees for particular types of work such as:

  • advice on your contract of employment

  • routine compromise agreements
